CENTRAL TEXAS CHIEF ELECTED OFFICIALS

INTERLOCAL AGREEMENT

 

LEGAL AUTHORITY:  40 TAC §801.  The Chief Elected Officials in a workforce area shall enter into an Agreement for Local Procedures.

 

PURPOSE:  The purpose of this agreement is to update procedures to fulfill the chief elected officials role in the Central Texas Workforce System and to maintain a certified local workforce board.

 

CHIEF ELECTED OFFICALS CONSORTIUM:  The county judges in Bell, Coryell, Hamilton, Lampasas, Milam, Mills, and San Saba counties and the mayors of Killeen and Temple are designated as the Chief Elected Officials Consortium for the Central Texas Workforce Region as defined in 40 TAC § 801 (d)(1)(B).

 

SELECTION OF THE CHAIR OF THE CHIEF ELECTED OFFICIALS CONSORTIUM:  At every other annual meeting, the Chair of the Chief Elected Officials Consortium will be elected by majority vote and serve a two-year term.

 

ANNUAL MEETING:  The Chief Elected Officials Consortium will hold its annual meeting in March/April to review board appointments, partnership agreement and audit report. 

 

SPECIAL MEETINGS:  Special meetings may be called as necessary by the Chair or by any three members of the Chief Elected Officials Consortium.

 

QUORUM/VOTES:  Attendance by a majority of the Chief Elected Officials shall constitute a quorum.  A majority vote of those present shall constitute action by the consortium.

 

WORKFORCE BOARD SIZE:  The twenty-seven members of the Central Texas Workforce Board will represent all requisite categories, with the majority from business.

 

APPOINTMENT PROCESS FOR BOARD MEMBERS:  Appointments will meet the requirements established by the Texas Workforce Commission in its Chief Elected Official’s Membership Guide for Local Workforce Development Boards.  All counties will have Board representation appointed by each County Judge.  The representatives will be pro-rated based on population as follows:

CHARACTERISTICS OF BOARD APPOINTEES:  To the extent possible, an appointee should be a representative with optimum policy making authority within the entity represented.

 

“A representative with ‘optimum policy making authority’ is an individual who can reasonably be expected to speak affirmatively on behalf of the entity he or she represents and to commit that entity to a chosen course of action.”  [20 CFR§661.203(2)]

 

ROLES AND RESPONSIBILITIES REGARDING APPOINTMENTS:  Members will be representative of the gender and ethnic diversity found in the Central Texas region.

 

Ø      Number of board members per county will be apportioned by fair share based on population.  (See chart above)

Ø      For business representatives, county judges will consult with chambers of commerce and out-going workforce board members to fill vacancies from their counties.

Ø      For business representatives in Bell county, the county judge will also consult with the mayors of the cities of Killeen and Temple.

Ø      For all other categories, recruitment also includes recommendations from the out-going board member and from representatives from the special sector involved.  The person most qualified to represent the sector will be selected by the appropriate county judge.

Ø      The Chair of the Chief Elected Officials Consortium will sign the official nomination form for all appointments.

 

COMMUNICATION:  The members of the Chief Elected Officials Consortium of Central Texas will be included in the distribution system of all relevant workforce materials to include monthly board briefing materials, annual strategic planning meeting, and all other special events.

 

RESOURCES ALLOCATION:  Resources shall be allocated to the counties utilizing the fair-share formulas.  Non-formula resources will be allocated by grant requirements.

 

PARTNERSHIP AGREEMENT:  The Chief Elected Officials Consortium will have a Partnership Agreement with the Central Texas Workforce Board that designates the grant recipient to receive and be accountable for workforce funding and designates the administrative entity for the local workforce development area.
